Terms of use

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Здружение за животна средина ЕКОХАБ Скопје, a citizens' environmental association registered in the Republic of Macedonia with registration number 7939248, registered office at ул. Сава Михајлов 2 бр.15, Скопје - Гази Баба, Република Македонија ("Chisto.mk," "we," "us," or "our").

By accessing or using the Chisto.mk mobile application and web platform (collectively, the "Platform"), you agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Platform.

Effective date: 29 April 2026.

1.1 "Account" means the user profile created to access certain features of the Platform.

1.2 "Content" means any text, images, photographs, videos, data, or other materials submitted, posted, or displayed on the Platform.

1.3 "Cleanup Event" means an organized environmental cleanup activity posted on the Platform.

1.4 "Report" means a user-submitted record about a mapped pollution site, including location data, narrative fields, and optional photographs.

1.5 "Services" means all functionalities provided through the Platform, including waste reporting, cleanup organization, map visualization, and community engagement features.

1.6 "User Content" means all Content submitted by users to the Platform.

2.1 These Terms are governed by:

• Law on Obligations of the Republic of Macedonia (Official Gazette No. 18/2001)
• Law on Consumer Protection (Official Gazette No. 26/2023)
• Law on Electronic Commerce (Official Gazette No. 39/2014)
• Law on Personal Data Protection (Official Gazette No. 42/2020)
• Regulation (EU) 2016/679 (General Data Protection Regulation)
• Consumer Rights Directive 2011/83/EU

2.2 These Terms apply to all users accessing the Platform from any jurisdiction, with specific consumer protections applicable to users within the Republic of Macedonia and the European Union.

3.1 Service overview

Chisto.mk is a civic environmental platform. Through our mobile apps (iOS and Android) and public website, users can:

• View and interact with mapped pollution "sites" and user-submitted reports (including photos and locations)
• Comment on sites, save or share them, and see cleanup events scheduled at a site
• Create an account to submit reports, participate in the community, and receive optional notifications

We may also share aggregated or anonymised statistics with municipalities or partners where we describe in our Privacy Policy.

3.2 Platform role

Chisto.mk functions as a technology platform only. We do not:

• Provide waste collection or environmental cleanup services ourselves
• Guarantee that any authority will act on a report
• Assume responsibility for third-party cleanup events or injuries at such events
• Verify every user submission in real time (moderation may happen after publication)

3.3 No service guarantees

While we strive to keep the Platform available, we do not guarantee:

• Uninterrupted or error-free operation
• Municipal or institutional action based on submitted reports
• Specific processing times
• Compatibility with every device or operating system version

4.1 Age requirements

You must be at least 18 years old to create an Account. Users under 18 may view public content under parental supervision but may not register.

4.2 Account creation

To access account features in our mobile apps, you register with:

• A valid email address
• A mobile phone number you can verify with a one-time code (SMS or similar)
• Your name and a password that meets our security rules
• Optional profile information (for example a profile photo) where the product offers it

The public website may not offer full account registration; where it does not, account terms apply when you use the apps.

4.3 Account security

You are solely responsible for:

• Maintaining the confidentiality of your login credentials
• All activities occurring under your Account
• Immediately notifying us of any unauthorized access

We are not liable for losses arising from unauthorized use of your Account unless due to our gross negligence.

4.4 Account accuracy

You represent and warrant that:

• All registration information is accurate, current, and complete
• You will maintain and update your information as necessary
• You will not impersonate any person or entity
• You will not create multiple accounts for improper purposes

5.1 Permitted use

You may use the Platform solely for:

• Reporting legitimate waste and pollution incidents
• Organizing or participating in cleanup events
• Viewing environmental data and maps
• Engaging constructively with the community

5.2 Prohibited activities

You must not:

5.2.1 False reporting

• Submit knowingly false, misleading, or inaccurate reports
• Fabricate waste incidents or locations
• Manipulate geolocation data

5.2.2 Harmful content

• Upload content that is defamatory, obscene, threatening, or hateful
• Post discriminatory content based on race, ethnicity, religion, gender, or other protected characteristics
• Share content that violates privacy rights of identifiable individuals
• Include personal data of third parties without consent

5.2.3 Platform abuse

• Use automated systems, bots, or scrapers to access the Platform
• Attempt to gain unauthorized access to Platform systems
• Interfere with or disrupt Platform functionality
• Circumvent security measures or authentication mechanisms

5.2.4 Commercial misuse

• Use the Platform for unauthorized commercial purposes
• Post spam, advertising, or promotional content without permission
• Collect user data for marketing purposes

5.2.5 Intellectual property violations

Upload content that infringes third-party copyrights, trademarks, or other intellectual property rights

5.3 Consequence of violations

We reserve the right to, without prior notice:

• Remove violating content
• Suspend or terminate your Account
• Report illegal activities to competent authorities
• Pursue legal remedies for damages

6.1 User content ownership

You retain all ownership rights to your User Content. By submitting Content to the Platform, you grant Chisto.mk a worldwide, non-exclusive, royalty-free, sublicensable license to:

• Display, reproduce, and distribute your Content on the Platform
• Use aggregated and anonymized data for statistical analysis and municipal reporting
• Include your Content in promotional materials (with your consent)

6.2 User content representations

By submitting Content, you represent and warrant that:

• You own or have necessary rights to the Content
• Your Content does not infringe third-party rights
• Your Content complies with applicable laws
• You have obtained necessary consents for any identifiable individuals in photographs

6.3 Platform content ownership

All Platform software, design, text, graphics, logos, and other materials (excluding User Content) are owned by Chisto.mk or our licensors and are protected by:

• Macedonian copyright law (Law on Copyright and Related Rights, Official Gazette No. 47/2023)
• Macedonian trademark law (Law on Industrial Property, Official Gazette No. 21/2009)
• International intellectual property treaties

6.4 Limited license to users

We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. This license does not permit:

• Modification, distribution, or reproduction of Platform content
• Reverse engineering or decompiling Platform software
• Creating derivative works
• Commercial exploitation without written permission

7.1 Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference.

7.2 We process personal data in accordance with:

• Law on Personal Data Protection (Official Gazette No. 42/2020)
• Regulation (EU) 2016/679 (GDPR)
• Our Privacy Policy available at https://www.chisto.mk/en/privacy

7.3 Processing of your personal data is described in our Privacy Policy, including the legal bases in Section 4 of that Policy. Where we rely on consent, it applies only to the processing stated there and you may withdraw it as described in the Privacy Policy. Other processing may rely on contract, legitimate interests, legal obligation, or other bases permitted by law.

8.1 Digital services and price

The core civic map and reporting features are currently provided without charge. Where we do not ask you to pay for access, many consumer "distance contract" rules (including the 14-day right of withdrawal under Directive 2011/83/EU) often do not apply in the same way as for paid digital content. Nothing in this Section limits mandatory rights that still apply to you under Macedonian or EU law.

8.2 Information we provide

We aim to give clear information about:

• Who operates the Platform (Section 17)
• What the Service does (Section 3)
• How to complain (Section 13)

8.3 Consumer disputes

Macedonian consumers may file complaints with:

9.1 THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION

9.2 We do not warrant that:

• The Platform will meet your specific requirements
• User-submitted reports will result in municipal action
• Platform data is current, accurate, or complete
• Defects will be corrected
• The Platform is free from viruses or harmful components

9.3 Some jurisdictions do not allow disclaimer of implied warranties. In such jurisdictions, the above disclaimers may not apply, and you may have additional rights.

10.1 General limitations

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

10.1.1 Chisto.mk shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages arising from user reliance on Platform content
• Damages resulting from third-party actions or content

10.1.2 Our total aggregate liability for all claims shall not exceed the greater of 100 EUR and the fees you paid us for the Service in the 12 months preceding the claim. If you paid no fees in that period (for example because the Service is free), the cap is 100 EUR.

10.2 Liability for mandatory legal obligations

Nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by gross negligence
• Fraud or fraudulent misrepresentation
• Violations of mandatory consumer protection rights
• Other liability that cannot be excluded under Macedonian law

10.3 Third-party liability

We are not responsible for:

• Actions or omissions of cleanup event organizers
• Injuries or damages occurring during cleanup events
• Municipal responses (or lack thereof) to reports
• Third-party content, websites, or services linked from the Platform

11.1 To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Chisto.mk, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• Your violation of these Terms
• Your violation of any laws or third-party rights
• Your User Content
• Your use of the Platform

11.2 We reserve the right to assume exclusive defense and control of any matter subject to indemnification, at your expense.

12.1 Modification of Terms

12.1.1 We may modify these Terms at any time by posting updated Terms on the Platform.

12.1.2 We will provide at least 30 days' notice of material changes via:

• Email notification to registered users
• Prominent notice on the Platform
• In-app notification

12.1.3 Continued use of the Platform after the effective date constitutes acceptance of modified Terms.

12.1.4 If you do not agree to modifications, you must discontinue use and may close your Account.

12.2 Platform modifications

We reserve the right to modify, suspend, or discontinue the Platform (or any features) at any time without liability.

12.3 Termination by User

You may terminate your Account at any time through account settings in the apps where available, or by contacting info@ekohab.mk.

12.4 Termination by Chisto.mk

We may suspend or terminate your Account immediately if:

• You breach these Terms
• Your conduct creates legal risk for us
• We are required to do so by law
• We cease operating the Platform

12.5 Effect of termination

Upon termination:

• Your access rights immediately cease
• We may delete your Account data (subject to legal retention obligations)
• Sections 6, 10, 11, 14, and 16 survive termination

We will attempt to resolve complaints within 30 days of receipt.

13.2 Amicable settlement

We are committed to resolving disputes amicably and in good faith.

13.3 Mediation

If direct resolution fails, parties may pursue mediation through recognized mediation services in the Republic of Macedonia.

13.4 Consumer ADR

EU consumers may use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

14.1 Governing law

These Terms are governed by and construed in accordance with the laws of the Republic of Macedonia, without regard to conflict of law principles.

14.2 Jurisdiction

14.2.1 For disputes with consumers: competent courts in the Republic of Macedonia as determined by mandatory consumer protection laws (generally, the consumer's place of residence).

14.2.2 For disputes with users who are not consumers (for example organisations using the Platform in a professional capacity): courts of Skopje, Republic of Macedonia, have exclusive jurisdiction.

14.3 Mandatory consumer rights

Nothing in this Section limits mandatory consumer rights under EU or Macedonian law, including the right to bring proceedings in the consumer's country of residence.

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including:

• Natural disasters, pandemics, or public health emergencies
• War, terrorism, or civil unrest
• Government actions or regulations
• Internet or telecommunications failures
• Cyberattacks or data breaches affecting third-party infrastructure

Performance obligations are suspended during force majeure events and resume when circumstances permit.

16.1 Entire agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Chisto.mk.

16.2 Severability

If any provision is found invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and remaining provisions remain in full effect.

16.3 No waiver

Failure to enforce any provision does not constitute a waiver of that provision or any other provision.

16.4 Assignment

You may not assign these Terms without our prior written consent. We may assign our rights and obligations without restriction.

16.5 Language

These Terms are executed in Macedonian, English, and Albanian. In case of conflict, the Macedonian version prevails for users in Macedonia; the English version prevails for international disputes.

16.6 Relationship

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.

16.7 Third-party rights

These Terms do not confer rights upon any third parties.

BY USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF USE.
